A will deals with your assets and minor children after you pass away. Powers of attorney are for use when you are alive. A power of attorney for personal care appoints someone to manage your personal care when you are unable to do so. A power of attorney for property appoints someone to manage your financial and business affairs on your behalf.
A standard will package includes a will, a power of attorney for personal care and a power of attorney for property. The cost for a standard package is $350 for one person. If a loved one passes away, then an estate trustee has the responsibility to settle the estate. The estate trustee may be named in a will or may be appointed by the court in the absence of a will. In both cases I counsel the estate trustee as to his or her responsibilities. This may include applying to the court to become appointed as the estate trustee without a will or to confirm your appointment as estate trustee with a will.
The estate pays the legal costs; and legal fees may be calculated as a percentage of the estate or on an hourly basis. You may contact me for an estate administration information sheet. |
